The fights over patent issues have been going on for a long time between Samsung and Apple. But the Korean tech giant is seems to win over the final fight. Today the Australian court finally rejected Apple’s appeal against the rejection of the ban put on Samsung’s Galaxy tab 10.1 sell in place in Australia by Justice Bennett. Samsung had appealed to the Federal Court of Appeals in October against the ban and the court made its decision in support of the Korean tech giant.
Although Apple could insist on extending the ban for another 7-days before their appeal to the High Court today the Cupertino based tech giant failed to satisfy the panel of 3 judges with enough evidences in support of their claim. As a result the judge panel made their decision in favor of Samsung and allowed them to sell the galaxy tab 10.1 in Australia.
The decision made today will surely effect the final out-come of the patent case. The tablets about which Apple has raised the patent claim can be out dated after it got to the final trial in the coming summer. Robert French who is a High Court chief justice mentioned that they found enough probability of success in Apple’s side so that they could apply for a full court trial.
Samsung has mentioned that they will be ready to sell the Galaxy tabs as soon as Monday. Some retailers who are expected to offer the stock of galaxy tabs are Harvey Norman, JB Hifi, Good Guys, Myer, Bing Lee and Office Works. The Korean tech giant has mentioned that in the last trail on November 30 the reaction of the full bench of the federal court of Australia was quite clear to deduce that Apple’s claim was less meritorious and the ban was not a right decision.
